2. MARTIAL ARTS, BRAZILIAN JIU-JITSU, SELF DEFENSE, WORKSHOPS, SEMINARS, CAMPS, PHYSICAL FITNESS TRAINING, JUDO, JIU-JITSU, GRAPPLING, GAMES, EXERCISES, LAW ENFORCEMENT TRAINING, WEAPONS TRAINING, MMA TRAINING, KICK-BOXING, PUNCHING, AND KICKING ARE INHERENTLY DANGEROUS ACTIVITIES AND ENTAIL SIGNIFICANT RISKS, BOTH KNOWN AND UNKNOWN.

3. THE USE OF Auxano Grapple Club SERVICES, FACILITIES, AND EQUIPMENT AT THIS LOCATION, ALL OTHER LOCATIONS, AND ANY OTHER OFF-SITE LOCATIONS IS INHERENTLY DANGEROUS AND ENTAILS SIGNIFICANT RISKS, BOTH KNOWN AND UNKNOWN.

4. I understand the inherently dangerous nature of these activities and I acknowledge the significant risk to myself and my child, if any are listed as participants below, as a result of my participation in any of the activities that are listed in Section (2) and Section (3) of this Agreement. I have read Section (2), Section (3) of this Agreement. I AGREE THAT I KNOWINGLY ASSUME THESE RISKS, INCLUDING THOSE THAT ARE UNKNOWN, AND THAT I SHALL NOT PURSUE LEGAL ACTION AGAINST Auxano Grapple Club FOR ANY BODILY, EMOTIONAL, OR ECONOMIC HARM THAT HAS RESULTED FROM THE USE OF Auxano Grapple Club SERVICES, FACILITIES, OR EQUIPMENT.

5. I understand that this document is intended to release and hold harmless Auxano Grapple Club and its representatives in the event that Auxano Grapple Club or any of its representatives are negligent or grossly negligent. ACCORDINGLY, I AGREE, ON BEHALF OF MYSELF OR MY CHILD, IF ANY ARE LISTED AS PARTICIPANTS BELOW, TO SPECIFICALLY RELEASE Auxano Grapple Club FROM LIABILITY AND TO HOLD Auxano Grapple Club HARMLESS FOR ANY BODILY, EMOTIONAL, OR ECONOMIC INJURY THAT IS THE DIRECT OR INDIRECT RESULT OF THE NEGLIGENCE OR GROSS NEGLIGENCE OF Auxano Grapple Club OR ITS REPRESENTATIVE.

6. I certify that I am or my child is, if any are listed as participants below, in good physical condition, and have no disease, injury or other condition that would impair my or my child’s, if any are listed as participants below, performance or physical and mental well-being during any activities.

7. I agree that I am entering into this Agreement voluntarily. No representative or agent of Auxano Grapple Club has sought to coerce me into signing this Agreement or placed me in a state of duress. I understand, upon receiving this Agreement that time is not of the essence. I have the right and the ability to review this document at my leisure and that it is in my best interest to consult an attorney before signing any binding legal document. In the event that I choose to exercise my right to review this document and to seek the counsel of an attorney, then I understand that Auxano Grapple Club will honor any promotional discounts or specials that existed on the date that I first received this Agreement.

8. I agree and represent that, if I am signing this Agreement on behalf of myself, I am 18 years of age or older. I agree and represent that, if I am signing this Agreement on behalf of my child, the listed minor participant is either (a) my biological child or (b) a child over which I am the appointed legal guardian. In the event that such is not the case, then I AGREE TO INDEMNIFY, RELEASE, AND HOLD HARMLESS Auxano Grapple Club FOR ANY LOSSES, INJURIES, OR DAMAGES RELATED TO THE MINOR CHILD’S PARTICIPATION. I understand that, by signing this agreement, I agree that I SHALL NEITHER (A) PURSUE ANY CIVIL SUITS against Auxano Grapple Club, NOR SHALL I (B) SEEK TO RECOVER DAMAGES, ATTORNEY FEES, COURT COSTS, OR OTHER FORMS OF COMPENSATION from Auxano Grapple Club. 

9. I agree that I, or my child, if any is listed as a participant below, shall use and accept items and equipment from Auxano Grapple Club “AS IS.” I UNDERSTAND THAT Auxano Grapple Club DISCLAIMS ALL WARRANTIES AND REPRESENTATIONS FOR ALL ITEMS AND EQUIPMENT THAT Auxano Grapple Club GIVES, LOANS, OR SELLS. I AGREE TO ASSUME THE RISK FOR ANY ITEMS AND EQUIPMENT THAT I USE OR ACCEPT FROM Auxano Grapple Club.

10. Severability. If any term of this Agreement is to any extent invalid, illegal, or incapable of being enforced, such term shall be excluded to the extent of such invalidity, illegality, or unenforceability; all other terms hereof shall remain in full force.

I HAVE READ AND CONSIDERED THE RISK FACTORS THAT ARE LISTED ABOVE. I AGREE AND UNDERSTAND THAT THESE ARE NOT ALL OF THE RISKS ASSOCIATED WITH PARTICIPATION IN Auxano Grapple Club ACTIVITIES, AND THE ABOVE LISTED RISKS IN NO WAY LIMIT THE SCOPE OF THIS AGREEMENT. IT IS MY INTENT TO PARTICIPATE IN Auxano Grapple Club ACTIVITIES AND TO USE Auxano Grapple Club FACILITIES AND EQUIPMENT DESPITE THESE RISKS. I KNOWINGLY AND VOLUNTARILY ASSUME THE RISKS THAT ARE INHERENT IN PARTICIPATION.
